Acceptable Use Policy
Guidelines for the acceptable use of Unified Microsystems systems, services, and resources by clients, partners, and employees.
1. Introduction
This AUP describes prohibited activities on the Supplier's network. The policy may be amended periodically, with changes posted at unifiedmicro.systems at least 15 days in advance. Continued service use constitutes acceptance of updates. Material adverse changes allow a 30-day termination notice. The AUP is part of the service agreement, and violations can result in service suspension or termination. Users are responsible for all violations by themselves or authorised users.
2. Internet Abuse
Prohibited activities include:
- Unauthorised access attempts, vulnerability testing, or security breach attempts without express authorisation
- Network monitoring, data collection by deception, password theft, phishing, and port scanning
- Using accounts or computers without authorisation or misrepresenting identity
- False, misleading, or deceptive TCP-IP packet headers or email/newsgroup headers
- Distributing software that covertly gathers or transmits user information
- Activities likely to trigger retaliation against the network
- Violations of data protection, internet proxy, or VoIP laws
- Introducing intentionally or knowingly any virus or other contaminating program into the Service
- Sending unsolicited emails (spam)
- Service interference including mail bombing, flooding, overload attempts, or broadcast attacks
3. Security
Users must:
- Take reasonable security precautions
- Use anti-virus software and perform regular equipment scans
- Create passwords with at least 8 mixed alpha and numeric characters with case variations, avoiding common words
- Protect password confidentiality and change regularly
4. Bulk Email
Bulk mail is prohibited through Managed Mail Service but permitted on dedicated hosted systems, subject to policy restrictions.
5. Direct Marketing
Email marketing requires prior recipient consent. Advance supplier approval is required. Requirements include:
- Affirmative recipient consent via opt-in procedures
- Reasonable means ensuring consent from actual email address owners
- Retained evidence producible within 72 hours
- Email body must disclose consent source and provide evidence request instructions
- Revocation procedures implemented within 72 hours
- Posted abuse@yourdomain.com address registered at abuse.net with prompt responses
- Privacy Policy posted for each associated domain
- Anonymous complaint tracking capability
- Clear email source identification with recipient address visible
6. Privacy Standards
These policies apply to hosting service messages or network messages referencing hosted sites. Compliance includes: monitoring and random opt-in verification; prohibition on unsolicited emails; and no vulnerability testing without prior written consent.
7. Other Networks
Users must comply with the rules and conventions for bulletin boards, chat groups, IRC, USENET, and other network forums accessed via the service.
8. Offensive Content
Prohibited content includes material that is:
- Child pornography, obscene, sexually explicit, or morally repugnant
- Excessively violent, incites violence, threatens violence, or contains harassment or hate speech
- Unfair, deceptive, includes chain letters or pyramid schemes
- Defamatory or violates privacy
- Creates safety/health risks, compromises national security, or interferes with law enforcement
- Improperly exposes trade secrets or infringes intellectual property
- Assists in defeating copyright protections
- Discriminatory regarding sex, race, or age
- Involves theft, fraud, drug trafficking, money laundering, or terrorism
- Illegal or solicits illegal conduct
9. Export Control
Services cannot be used by entities violating export control laws or involved in illegal gambling, terrorism, narcotics trafficking, arms trafficking or weapons proliferation.
10. Copyrighted Material
Users cannot download, publish, distribute, or copy copyright-protected works unless expressly authorised by the copyright owner and permitted by applicable law.
11. Copyright Infringement
The Supplier terminates services for copyright infringers per the General Terms and Conditions.
12. Cooperation with Investigations and Legal Proceedings
The Supplier may monitor content and traffic for lawful use compliance. Content may be intercepted or blocked if unlawful, with 7 days to remedy after formal notice. The Supplier may report suspected legal violations to authorities and provide information to law enforcement with reasonable prior notice where legally required.
13. Shared Systems
Users cannot unnecessarily interfere with shared system operation or consume disproportionate resources. Automated access violating these terms may be blocked. Virus-infected or corrupted data may be quarantined or deleted.
14. Resource Limits
- Shared hosting: load average over a 20-second period will not exceed more than 5 seconds of CPU time
- VPS hosting: total load average over 5 minutes cannot exceed 100% of allocated processing or memory resources
- Unless specified on invoice, bandwidth is limited; accounts suspend upon limit reached
15. Upgrade Option
Exceeding resource limits triggers a supplier upgrade quote. Declining the upgrade results in account reactivation after the first two suspensions; the third suspension remains active until an upgrade is accepted or the service is terminated.
16–18. Contact Information, IP Usage, and Blacklists
- Users must maintain valid, current domain registrar information for any hosted domain.
- Users may only use IP addresses assigned by Supplier staff or systems.
- Users cannot take actions resulting in Supplier IP space blacklist listings.
19. Consequences of AUP Violation
Users are strictly responsible for hosting service use that violates this AUP. The Supplier charges standard hourly rates for work addressing breaches, including investigation, harm remediation, complaint responses, and blacklist removal.
20. Disclaimer
We are under no duty, and by this AUP are not deemed to undertake a duty, to monitor or police our customers' activities and we disclaim any responsibility for any misuse of our network.
